01Who Fazilabs is

Fazilabs Technologies Ltd ("Fazilabs", "we", "us" or "our") is a software studio based in Nairobi, Kenya. We build websites and digital products for businesses, and we operate Fazilabs Messaging, an application that lets people reach Fazilabson WhatsApp using Meta's WhatsApp Business Platform (also known as the WhatsApp Cloud API).

02Scope of this policy

This policy applies to information we collect through the Fazilabs website (fazilabs.com) and through Fazilabs Messaging, including when you message us on WhatsApp. It does not apply to WhatsApp, Meta, or any other third-party platform or website, each of which has its own privacy practices as described in WhatsApp's Privacy Policy and Meta's Privacy Policy.

03Information you provide to us

We collect information you choose to give us directly, such as when you:

• Fill in a contact or enquiry form on our website
• Email us at hello@fazilabs.com
• Message us on WhatsApp through Fazilabs Messaging
• Otherwise correspond with us about our services

This typically includes your name, email address, phone number, and the content of whatever message, question or request you send us.

04Information collected through WhatsApp

When you message Fazilabs through Fazilabs Messaging, the WhatsApp Business Platform passes certain information to our systems so that we can receive and respond to your message. This includes:

Phone number and WhatsApp identifiers

The WhatsApp phone number and associated WhatsApp account identifier you used to message us. We use this to identify the conversation and to send you a reply on the same thread.

Message content

The text, media, or other content of the messages you send us, and the replies we send back, for as long as that conversation history is useful for providing support or continuing the exchange.

Message metadata

Information WhatsApp provides alongside a message, such as timestamps, delivery and read status, and your WhatsApp display name if you have set one. We do not control what profile information WhatsApp or Meta exposes to us as part of this metadata.

05Technical and log information

Like most websites, our servers and hosting infrastructure automatically log certain technical information when you visit fazilabs.com, such as IP address, browser and device type, pages viewed, and timestamps. Where enabled, we may also use privacy-respecting analytics tools (such as Google Analytics) to understand aggregate traffic patterns to our website. This section does not apply to WhatsApp conversations, which are covered above.

06How we use information

We use the information described above to:

• Receive, read and respond to messages and enquiries sent to us, whether by email, web form or WhatsApp
• Provide customer support and answer questions about our services and products
• Deliver information you have requested, and, where appropriate, automate routine or repetitive responses
• Operate, maintain, secure and improve the Fazilabs website and Fazilabs Messaging
• Keep records of business correspondence, and meet legal, accounting or regulatory obligations

We do not use the content of your WhatsApp conversations to build advertising profiles, and we do not sell personal information.

07The WhatsApp Business Platform and Meta

Fazilabs Messagingis built on Meta's WhatsApp Business Platform (WhatsApp Cloud API). When you message Fazilabs on WhatsApp, your message is transmitted through infrastructure operated by Meta before it reaches our systems, and Meta processes that transmission under its own terms and privacy policy.

Meta and WhatsApp act as an independent data controller (or processor, depending on context) for the parts of this exchange that occur on their platform. We do not control, and are not responsible for, how Meta or WhatsApp independently collect, use, store or process information on their side of that integration. Their handling of your information is governed by WhatsApp's Privacy Policy and Meta's Privacy Policy, which we encourage you to review.

08Service providers and infrastructure

We rely on third-party infrastructure and service providers to operate our website and Fazilabs Messaging— for example, hosting and cloud infrastructure providers, email delivery services, and Meta's WhatsApp Business Platform itself. These providers process information on our behalf, solely to help us deliver the service, and are not permitted to use it for their own independent purposes beyond what is required to provide their service to us (Meta's own independent processing is described in the section above).

09When we may disclose information

We may share information:

• With service providers who process it on our behalf, as described above
• If required to do so by law, regulation, legal process, or a valid request from a public authority
• To protect the rights, property, or safety of Fazilabs, our users, or others
• In connection with a merger, acquisition, or sale of business assets, subject to continued protection under a policy of this kind
• With your consent, or at your direction

We do not sell personal information to third parties.

10Data retention

We keep information for as long as reasonably necessary to respond to your enquiry, provide support, maintain accurate business records, and meet any legal, accounting or regulatory requirements that apply to us. How long that takes varies by the type of information and the context in which it was collected — for example, an active support conversation is generally kept longer than a resolved one. When information is no longer needed for these purposes, we take steps to delete or anonymise it, subject to the exceptions described under Data retention in Meta's own policies for information that remains on their platform.

11Security

We take reasonable administrative and technical measures intended to protect information from unauthorised access, alteration, disclosure or loss. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Message transport between WhatsApp and our systems is governed by Meta's own security practices for the WhatsApp Business Platform.

12Your privacy rights

Depending on where you are located, you may have rights in relation to the personal information we hold about you, which can include the right to ask us to confirm what information we hold, to correct inaccurate information, to request deletion, or to object to or restrict certain processing. To exercise any of these rights, contact us using the details below. We will respond to legitimate requests within a reasonable time and may need to verify your identity before acting on a request.

13Data deletion requests

You can ask us to delete personal information we hold about you, including information collected through WhatsApp conversations with Fazilabs Messaging. Full instructions, including what to include in your request, are available on our dedicated Data Deletion Instructions page. Some information may need to be retained where we have a legal or legitimate operational reason to do so, as explained on that page.

14Third-party services and links

Our website may link to third-party websites or services we do not operate, and Fazilabs Messaging depends on the WhatsApp Business Platform operated by Meta. We are not responsible for the privacy practices or content of any third-party service. We encourage you to review the privacy policy of any third-party service before providing it with information.

15Children's privacy

Our website and Fazilabs Messaging are intended for a general business audience and are not directed at children. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will take appropriate steps to remove it.

16Changes to this policy

We may update this policy from time to time to reflect changes to our services, legal requirements, or business practices. When we do, we will update the "Last updated" date at the top of this page. We encourage you to review this page periodically.
